1. Scope
These General Terms and Conditions (the “Terms”) apply to all orders and contracts concluded through the online shop kaffee-esepads.ch.
The online shop is operated by:
kaffee-esepads.ch
Michelli Design
Limmatstrasse 50

The offering is primarily intended for customers resident or established in Switzerland. Delivery is made to the delivery addresses available for selection at checkout.
Consumers are natural persons ordering predominantly for private purposes. Business customers (B2B) are natural or legal persons or partnerships ordering for their professional or commercial activities when concluding the contract. The information provided and the identifiable purpose of the order at the time the contract is concluded are decisive; subsequent business use alone is insufficient.
The version of these Terms published on the website at the time of the order applies. Any differing terms of the customer apply only if we have expressly accepted them in writing.
2. Products and information
We endeavour to keep product details, images, prices, availability and delivery times accurate and up to date. Product images are for illustration. Minor differences in packaging, colour, presentation or design are reserved, provided they do not alter the essential characteristics of the product.
Availability and delivery time information is prepared with care but is not a guarantee. Supply shortages, short-notice changes to the range, technical errors, obvious mistakes and printing or display errors remain reserved.
Before ordering, the customer must check the compatibility of machines, capsules, pods, accessories, power supply and connections. A particular intended use or suitability is assured only if we have expressly confirmed it in writing on the basis of complete information.
Installation and commissioning are owed only if they are expressly included in the offer. The customer must ensure suitable site conditions, in particular the required power and water supply, permitted water pressure, suitable water hardness and filtration, ventilation and ambient temperature. Where the manufacturer requires qualified personnel, installation must be carried out accordingly.
Pre-orders are possible only where a product is expressly offered for pre-order. The stated availability or delivery time is an estimate unless a binding date has been assured in writing.
Orders exceeding normal household quantities, orders containing recognisably false information, and orders where there are reasonable grounds to suspect misuse or commercial resale may be rejected or limited in quantity.
3. Prices, delivery charges and surcharges
All prices are stated in Swiss francs (CHF) and include statutory VAT where applicable.
Delivery charges, discounts, vouchers, any surcharges and the total amount are shown before the order is completed. The following delivery terms currently apply to this shop:
- Slower “Economy” delivery: CHF 9.00
- “Priority” express delivery: CHF 9.00
- Free delivery: from CHF 50.00 in goods
Thresholds apply to the value of goods after discounts and vouchers, excluding delivery charges and surcharges. The calculation displayed at checkout for the specific basket is decisive. Further information is available on the Delivery page.
In the event of obvious pricing errors or incorrect technical displays, we are not obliged to deliver at the incorrect price. In such cases, we will inform the customer and refund payments already made if no contract is concluded at the correct price.
4. Orders and conclusion of contract
The presentation of products in the online shop is not a binding offer but an invitation to the customer to place an order.
By submitting the order, the customer makes a binding offer to purchase the products in the basket. Before submission, products, quantities, billing and delivery addresses and other information can be checked and corrected in the basket and at checkout.
An order confirmation is sent automatically by email upon receipt of the order. This confirms receipt of the order but does not yet constitute acceptance of the offer.
The contract is concluded only when we expressly accept the order, confirm dispatch or deliver the goods. Until then, we may reject all or part of the order, in particular due to unavailability, incorrect or delayed stock data, double sales resulting from a system or synchronisation failure, obvious pricing or description errors, outstanding payment, a failed security check or reasonable grounds to suspect misuse.
If unavailability is discovered only after the contract has been concluded, we will inform the customer without delay. A longer waiting period or a substitute product will be agreed only with the customer's consent. If delivery is permanently impossible, we may, to the extent permitted by law, withdraw from the part of the contract that cannot be performed. Payments already made for undelivered goods will be refunded using the original payment method. Mandatory statutory claims remain reserved.
5. Payment
The payment methods displayed during the ordering process can be selected subject to availability. Depending on the shop and the selection, payments are processed in particular through Payrexx (including TWINT and the cards offered), Stripe, PayPal, HeyLight and bank transfer, where the relevant method is offered at checkout. There is no entitlement to any particular payment method.
Payments must be made in Swiss francs (CHF). Credit cards, TWINT, PayPal or other immediate payment methods may be charged when the order is placed or immediately afterwards. If no contract is concluded, any amount already charged will be refunded.
For advance payment, goods are dispatched only after payment has been received in full. For purchases on invoice, the invoice amount must be paid in full without deductions within the stated period. Payment service providers may apply their own terms of use, security requirements and privacy policies.
6. Late payment
If the customer falls into arrears with a payment due, we may issue reminders for outstanding amounts, withhold further deliveries and withdraw from the contract after an additional payment period has expired without payment. Reasonable reminder, chargeback and debt collection costs actually incurred may be passed on to the extent permitted by law.
Outstanding claims may be referred or assigned to third parties for collection to the extent permitted by law.
7. Delivery
Delivery is made to the delivery address specified by the customer at checkout and accepted by the shop. The customer is responsible for complete and correct information and for the accessibility of the delivery address.
Our products may be dispatched from several warehouses at different locations in Switzerland. Warehouse allocation, internal stock transfers, differing product availability and partial deliveries may therefore result in different processing, dispatch and delivery times within the same order. Partial deliveries are permitted where reasonable and do not incur additional delivery charges.
Stated delivery times are based on the stock and transport information known at the time of ordering and are indicative unless a binding delivery date has been expressly assured. To the extent permitted by law, reasonably exceeding a non-binding estimate does not in itself give rise to a claim for damages, a price reduction or termination of the contract.
In the event of delays due to warehouse allocation, stock transfers, manufacturer supply shortages, transport providers, force majeure, official measures, operational disruptions or other circumstances beyond our reasonable control, the delivery period will be extended appropriately. Mandatory statutory rights and delivery dates expressly assured in writing remain reserved.
If a shipment cannot be delivered due to incorrect address details, failure to collect, refusal of acceptance or other reasons attributable to the customer, documented additional costs for return transport, storage and redelivery may be charged.
8. Inspection and notification of defects
After receipt, the customer must inspect the delivered goods for correctness, completeness, transport damage and visible defects as soon as possible in the ordinary course of business.
Incorrect deliveries, incomplete deliveries, visible transport damage and apparent defects must be reported by email as soon as possible, and no later than five calendar days after delivery, to [email protected]. The report should include the order number, a precise description and suitable photographs or other evidence.
Hidden defects must be reported immediately upon discovery. The goods must be kept until the matter has been clarified. Goods may be returned only after our prior written confirmation and in accordance with the return instructions provided. Unsolicited returns or disposal of goods without instructions may make assessment and processing more difficult; mandatory statutory rights remain reserved.
9. No voluntary right of withdrawal, return or exchange
Swiss law does not provide a general statutory right of withdrawal or return for ordinary online purchases. We therefore grant no voluntary right of withdrawal, return or exchange for correctly delivered goods free of defects. Orders are binding once the contract is concluded. Dislike of a product, an incorrect choice by the customer or a subsequent change of mind does not create an entitlement to return, exchange or refund.
Any goodwill arrangement exceptionally approved in writing is voluntary, without acknowledgement of a legal obligation and without effect on other cases. Goods returned without prior written approval may be refused.
The customer bears the costs and risks of an approved goodwill return, except in cases of confirmed incorrect delivery or a defect for which we are responsible. Opened food products, coffee, capsules, pods, hygiene products, customised products, and damaged, used or incomplete goods are excluded from goodwill arrangements. Mandatory statutory rights relating to defects remain reserved.
10. Cancellations
There is no entitlement to cancellation after the contract has been concluded. If we exceptionally agree to a cancellation in writing, documented payment, processing, dispatch, return transport and storage costs already incurred, as well as any loss in value, may be deducted from a refund.
Our right to reject or cancel an order, in particular due to unavailability, obvious pricing errors, outstanding payment, a failed security check or suspected misuse, remains reserved. Payments already made for undelivered goods will be refunded.
11. Statutory warranty and guarantees
In the event of proven defects reported in good time, applicable Swiss law and the following provisions apply. For new goods sold to consumers, the statutory limitation period for warranty claims is generally two years from delivery. No shortening of mandatory statutory periods is intended.
For business-to-business (B2B) sales contracts where the machine is intended for the buyer's professional or commercial activities, the limitation period for claims concerning defects in new machines is reduced to twelve months from delivery to the extent permitted by law. This reduction does not apply to consumer contracts. The intended purpose at the time the contract is concluded is decisive, rather than the type of machine alone or subsequent business use.
For goods expressly offered as used, second-hand, demonstration or display units, the limitation period for consumers is reduced to one year from delivery to the extent permitted by law. Clearly disclosed signs of use, operating hours, meter readings and known deviations are deemed agreed characteristics and do not constitute defects.
To the extent permitted by law, defects will initially be remedied by repair or replacement at our choice. If the chosen solution is impossible, disproportionate or cannot be implemented within a reasonable period, price reduction, reversal of the transaction and other claims are governed by applicable law.
In particular, defects do not include normal wear, wearing parts, age-related or usage-related wear, or damage caused by improper use, unsuitable site or connection conditions, incorrect cleaning or descaling, absent or inadequate maintenance, limescale, falls, moisture, frost, power surges, unauthorised interventions, unsuitable accessories or unsuitable consumables.
Warranty claims must be reported in writing before any return, including the order number, a description of the fault and suitable photographs or videos. For machines, the model designation, serial number, purchase date, displayed error codes and operating circumstances must also be provided where this information is available and reasonably accessible.
Before returning goods, the customer must cooperate in a reasonable and safe initial fault diagnosis. This may include reading error codes, restarting the machine, checking connections and carrying out safe cleaning or descaling steps according to our instructions. Opening the machine or performing other dangerous interventions or interventions that cannot reasonably be expected of a non-specialist is not required.
Where the cause of a defect may be connected with maintenance, cleaning, descaling or the intensity of commercial use, available maintenance, cleaning and descaling records and evidence of servicing must be provided on request. Missing records do not automatically remove mandatory statutory rights, but may make technical assessment and identification of the cause more difficult.
Goods may be dispatched only after our written confirmation and in accordance with our return instructions. An approved return must be sufficiently padded and sent in the original packaging or equivalent packaging suitable for transport. The customer is liable for damage and documented additional costs caused by inadequate packaging, an unapproved return, carriage-unpaid shipments or failure to follow the return instructions. For a confirmed warranty claim, we cover the necessary costs of the return we have instructed; if the assessment finds no defect for which we are responsible, reasonable assessment and transport costs may be charged after prior notification, to the extent permitted by law.
No voluntary shelf-life or taste guarantee is provided for food and consumable products such as coffee, capsules and pods beyond statutory or expressly assured product characteristics.
The statutory warranty for defects is a claim against us as the seller and exists independently of any voluntary manufacturer's guarantee. A manufacturer's guarantee does not restrict mandatory statutory claims against us.
A voluntary manufacturer's guarantee is a separate undertaking by the manufacturer or guarantor identified in the guarantee document. Its scope, duration, exclusions and procedure are governed exclusively by the relevant guarantee terms; claims under it may need to be handled directly through the manufacturer or a designated service centre. A manufacturer's guarantee does not extend our statutory obligations as the seller.
The manufacturer's operating, care, cleaning, descaling and safety instructions must be followed. In the event of a safety warning or recall, use must cease immediately where required and the customer must cooperate with the specified procedure.
12. Repairs outside statutory warranty or guarantee coverage
Repairs outside an accepted statutory warranty or guarantee claim are carried out only by prior agreement. The customer may be charged for assessment, quotations, labour, spare parts, packaging and delivery.
If a quotation is rejected or not answered within the stated period, the product may be returned at the customer's expense.
Repaired or assessed products must be collected or released for return within the stated period. After a reminder and a reasonable additional period, previously announced, documented storage costs and the cost of return delivery may be charged. Disposal, realisation of value or transfer of ownership does not occur automatically, but only on the basis of an express agreement or a statutory provision.
13. Vouchers, discounts and promotions
Vouchers, discount codes, loyalty benefits and promotions apply only for the stated duration and under the published terms. They may be restricted to certain products, customer groups, quantities or minimum order values and generally cannot be combined.
Cash redemption, interest or retrospective credit is excluded unless mandatory law or an expressly published condition provides otherwise. If a defective delivery is reversed, no more than the amount actually paid will be taken into account.
14. Liability
We are liable without limitation for damage caused intentionally or through gross negligence. In cases of minor negligence, we are liable, to the extent permitted by law, only for direct and foreseeable damage arising from a breach of essential contractual obligations. Otherwise, liability for minor negligence, indirect damage, consequential damage, lost profit and data loss not caused by us is excluded.
To the extent permitted by law, no liability is accepted for damage caused by improper use, failure to follow operating, care, safety or descaling instructions, or use of unsuitable products or accessories.
Mandatory statutory liability, in particular for personal injury and damage caused intentionally or through gross negligence, remains unaffected. We accept no responsibility for the content of external websites linked to by the online shop.
15. Data protection
We process personal data in connection with website visits, customer accounts, orders, payments, delivery, communication and defect, warranty and guarantee claims in accordance with applicable Swiss data protection law and our separate privacy policy.
To process an order, necessary data may be disclosed in particular to payment providers, shipping and logistics partners, hosting and IT service providers, accounting services, advisers, debt collection services and public authorities where necessary for performance of the contract, operations, security, enforcement of rights or statutory obligations.
To document the conclusion of the contract while minimising data, we store only the identifier of the accepted version of the Terms and its technical checksum in the order record. The full text of the Terms is not saved again for every order, but archived centrally once per version. This creates no additional customer or profile data beyond the order data already required.
16. Retention of title
The delivered goods remain our property until payment has been made in full. We are entitled to have a retention of title entered in the appropriate register at the customer's expense where provided for by law or necessary to secure the claim.
17. Changes to the Terms
We may amend these Terms at any time for future orders. An order is governed by the version published and accepted by the customer at the time the contract was concluded. Later changes do not apply retrospectively to contracts already concluded unless a mandatory statutory provision requires otherwise.
Each published version of the Terms receives a unique version identifier that includes the shop and language, and is archived centrally. Only this version identifier and the technical checksum of the accepted version are stored in the order record. Together with the existing order timestamp, this makes it possible to establish later which Terms applied without duplicating the full text for every order.
18. Partial invalidity
If a provision of these Terms is wholly or partly invalid or unenforceable, the remaining provisions remain unaffected. The statutory rule applies in place of the invalid provision. The same applies to unintended omissions.
19. Applicable law and jurisdiction
All legal relationships are governed by substantive Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
To the extent permitted by law, the place of jurisdiction is the provider's registered office. Mandatory statutory places of jurisdiction, in particular consumers' rights to choose, remain expressly reserved.
